FACTS:
This is an adjourned enquiry resulting from the Dargaville meeting on 11 November 2011. This was due to time constraints following the last race and prearranged travel commitments.
Following race 8 the informant Mr Williamson filed an information pursuant to rule 638 (1) (d). He alleged that Miss D Johnson being the rider of DENVER permitted her mount to shift inwards near the 300 metres when not sufficiently clear of FLASH HAPI which was denied its rightful line of running
SUBMISSION(s):
Mr Oatham demonstrated the video films which showed DENVER leading the field just after turning for home. At this stage FLASH HAPI was racing approximately 1 ¼ lengths behind DENVER. Mr Oatham said there was sufficient room on the inside of DENVER for FLASH HAPI to improve into. However as he attempted to take this gap DENVER moved into his line taking his rightful line of running. The film clearly showed Miss Johnson continuing to ride forward while moving in 1 ½ to 2 horse widths. Mr Oatham said that although the interference to FLASH HAPI was not severe Miss Vance had to ease which may well have affected the chances of FLASH HAPI finishing in a better place.
Miss Johnson said DENVER was on the wrong leg turning for home and racing somewhat greenly. She said she was unaware Miss Vance was on her inside and she did not hear her call. She believed the affect on Miss Vance was minor as she only had to ease her mount.
Mr Williamson in summing up said FLASH HAPI was denied clear racing room. He said as FLASH HAPI who finished 4th and only beaten ½ a head for 2nd (dead heat) the consequences of Miss Johnson failing to straighten her mount may well have cost FLASH HAPI a better placing.
REASON(s):
The committee carefully considered all evidence and submissions. We are satisfied there was sufficient room for FLASH HAPI to improve into on the inside of DENVER It was clearly evident that Miss Johnson did allow her mount to move in when not the required distance clear of FLASH HAPI. The committee does not believe Miss Johnson took any corrective action to straighten her mount and for these reasons we find the charge proved.
DECISION:
For these reasons we find the charge proved.
SUBMISSION(s) ON PENALTY:
Mr Williamson said Miss Johnson had incurred 2 suspensions in the last 12 months. He submitted her carelessness on this occasion was mid range.
Miss Johnson said she had firm commitment up to and including 19 November and she rode throughout New Zealand.
REASON(s):
The committee considered the submissions as presented. The only mitigating factor is Miss Johnson’s good record. However this must be balanced against the interference caused to FLASH HAPI which had its chances of finishing in a better place extinguished. Miss Johnson did not stop riding forward and was not the required distance clear when moving in.
PENALTY:
After taking all the above into account and under the provisions of Rule 1106 we impose a suspension on Miss Johnson from riding in races which is to start after racing on 19 November and conclude after racing on 26 November 2011 (5 riding days).
