Mr Escott alleged that Mr Kerr was in breach of rule 864(2)(d) in that he failed to attach a towel used under the harness saddle which came adrift during the running. Mr Escott demonstrated on the video the towel coming loose as the horse commenced the run home.

Mr Kerr admitted the breach, which we thus find proved. He indicated on the information that he did not wish to be present.

Mr Escott asked for a fine of $100. We accept this is an appropriate penalty and is consistent with other penalties imposed for like breaches. Mr Kerr is fined the sum of $100 and reminded of his obligations under the Rules of Harness Racing.
