Decision: Following the running of the Ken Tarrant Memorial Mobile Pace, Mr N M Ydgren, Stipendiary Steward charged Mr G Phillips, Starter, with a breach of rule 857 (3) (i) (ii) alleging he failed to sound a recall (false start) after T K Saracen interfered with MYSTICAL MADDIE prior to the start.

Following the running of the Ken Tarrant Memorial Mobile Pace, Mr N M Ydgren, Stipendiary Steward charged Mr G Phillips, Starter, with a breach of rule 857 (3) (i) (ii) alleging he failed to sound a recall (false start) after T K Saracen interfered with MYSTICAL MADDIE prior to the start.  Mr Phillips did not admit the breach.

Mr Ydgren used the videos of the start of the race to assert that T K Saracen went into a break about 80 to 100m metres from the starting point and interfered with MYSTICAL MADDIE which started on the second line.  MYSTICAL MADDIE did not lose its gait but had to be restrained to clear T K Saracen and in doing so was three quarters to a length behind the field at the starting point.  Mr Ydgren believed Mr Phillips should have declared a recall as a result of the interference to MYSTICAL MADDIE.

Mr Phillips submitted that from his position he believed from the point at which T K Saracen went off stride there was sufficient opportunity for MYSTICAL MADDIE to have regained its rightful starting position by the starting point.  He believed that MYSTICAL MADDIE was sufficiently proximate to the second line runners at the start to warrant a true start being called.

The Committee in reaching a finding has had particular regard to the manner in which these events unfolded, and Mr Phillip’s quite reasonable belief that MYSTICAL MADDIE would regain its starting position and did, in his view, broadly start on terms with the field.  This was a judgement call to be exercised in the blink of an eye and in the Committee’s view it was reasonable for Mr Philips to have assumed that MYSTICAL MADDIE would achieve a fair start having recovered from the earlier interference caused by T K Saracen.
