Decision: Mr Davidson, stipendiary steward, alleged a breach of rule 508(2) and (5) in that Mr S Kennedy failed to declare riders for SNOW STORMER in race 1, MY WIFE in race 2, COLONEL BILL and FLYING TRIO in race 3, MISSAROOY BELLE in race 7, and DANGEROUS GOODS in race 8 by the required time.
Mr Davidson, stipendiary steward, alleged a breach of rule 508(2) and (5) in that Mr S Kennedy failed to declare riders for SNOW STORMER in race 1, MY WIFE in race 2, COLONEL BILL and FLYING TRIO in race 3, MISSAROOY BELLE in race 7, and DANGEROUS GOODS in race 8 by the required time. He admitted the breach and stated that he had had problems with his phone all day. He said people could ring in but he could not ring out and that he had not had the opportunity to use another phone. Riders were finally nominated, some 4 1/2 hours late.

Mr Kennedy has had no previous breaches of this Rule. We are aware the “standard fine” is $50 per horse. However, there are 6 horses involved on this occasion, with a mitigating factor. Mr Davidson has recommended that a fine of $150 is appropriate. We do not disagree and we impose a fine of $150.
