Following race 9 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendiary Steward Mr C George, that P Holmes, rider of DON BUCK, committed a breach of that Rule

Following race 9 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendiary Steward Mr C George, that P Holmes, rider of DON BUCK, committed a breach of that Rule when he shifted outwards near the 500 metres when not sufficiently clear of LEICA GAZELLE (C Treymane) who had to be checked by its rider with consequent interference to COME ON JIMMY (M Coleman) and MELINITE (M Wenn).

Mr A Coles demonstrated the videos which showed the field rounding the home turn near the 500 metre mark. The interference could be clearly seen as Mr Holmes angled his mount out when not sufficiently clear and causing the resultant multiple interference. As Mr Holmes, who was represented by Mr M Walker, admits the charge we are only required to consider the penalty.

PENALTY:

Mr George gave Mr Holmes' record over the last 12 months and added that he felt the offence was serious enough for a suspension to be enforced.

Mr Walker, on Mr Holmes' behalf, asked for a lesser suspension and a fine because of forward riding engagements.

--

The Committee agree with Mr George that a suspension is required.

--

--

After considering the seriousness of the interference we suspend Mr Holmes from the conclusion of racing on 10 September until the conclusion of racing on 16 September 2006.
