Following race 3 an information was laid against A Peard alleging a breach of Rule 871(1)(d)

DECISION & REASON:
--Following race 3 an information was laid against A Peard alleging a breach of Rule 871(1)(d) namely "in that he shifted inwards on CURRENCY KID when not sufficiently clear of BEAUBOURG ridden by S Collins who had to be sharply checked".
----Mr A Peard denied the charge.
----Evidence was called by the informant. Mr S Collins, rider of BEAUBOURG, said that Mr A Peard's mount ducked in sharply. He had to check his mount. He said it was a sharp check and stopped him where he was. He said his mount was only battling and it was only barely a length clear and he clipped a heel. He also said he called to Mr Peard.
----Mr Robinson demonstrated on the race videos (head-on and side-on) the incident. He said that Mr A Peard moved inwards when not sufficiently clear of BEAUBOURG causing a sharp check. He demonstrated on the video Mr A Peard moving inwards and still using the whip. He said that Mr Peard had no right to take Mr Collins' rightful line.
----Mr Peard's evidence was that he was traveling well and Mr Collins' mount bumped him and put him off stride. He moved in sharply and immediately straightened. He emphasized that Mr Collins' mount was battling. Also he pointed out his continual lug in down the straight. He said there was damage done but he was not at fault.
----We prefer the evidence of the informant and Mr Collins and Mr Robinson. We find that you moved inwards when not sufficiently clear of BEAUBOURG. Accordingly we find the charge proved to the required standard.
----PENALTY:
--After hearing submissions from Mr Oatham and Mr A Peard we have determined that a suspension must be imposed.
----Mr Oatham submitted that Mr Peard had just returned from a 3 week suspension for careless riding from February 2006, but otherwise had a very good record. Mr Oatham emphasized the incident involved a sharp check to BEAUBOURG, BEAUBOURG clipped a heel and there were safety concerns.
----Mr A Peard emphasized his good riding record and confirmed evidence as his explanation.
----You are suspended from the conclusion of racing on 22 March 2006 up to and including racing on 1 April 2006, 5 days.
