--Mr. Doyle admitted the breach.
--Mr. Goodwin said that Mr. Doyle struggled with his weight and his record was not a good one with three fines incurred within the last year.
--They were as follows:
--20/9/09 Counties $200
17/09/09 New Plymouth $100
28/06/09 Foxton $100
The Stewards submission was for a monetary penalty in the vicinity of $300.00.
--Mr. Doyle told the committee that he was a “good kilo” overweight today but expected to find it easier to lose weight with the summer months coming up. He explained that he worked extremely hard to maintain his weight but his natural size made this difficult. He can usually ride comfortably at 55 kilos.
--In coming to a decision on penalty we took into account all of the submissions including Mr. Doyle’s admission of the breach.
--It was our opinion that a $300.00 fine was too lenient considering Mr. Doyle’s record however we accept, and give credit to Mr. Doyle, that he does try very hard to keep his weight down. He was reminded that he should only be accepting rides in the weight range that he is sure he can commit to.
Mr. Doyle was fined the sum of $350.00.
