DECISION AND REASONS:
--Following the running of Race 8, Dakins Liquid Waste Handicap Trot, an information instigating a protest was filed by Stipendiary Steward, Mrs K R Williams, against THE FAT CONTROLLER (D J Dunn), placed 3rd by the judge, on the grounds of breaking from its gait. The precise details of the allegation were not set out in the information.

Mr D J Dunn, driver of THE FAT CONTROLLER, was not present at the hearing of the information but he had endorsed the information form “I do not contest the protest” and had signed it. The Committee was informed that a call had been put out for Mr C P Iggo, co-owner and trainer of THE FAT CONTROLLER, to attend the hearing but he did not appear. The hearing proceeded in his absence.

Mrs Williams informed the Committee that Mr Dunn had reviewed the video and had admitted to the Stipendiary Stewards that THE FAT CONTROLLER had gone away in a pace, then galloped and was still in a gallop well past the winning post in the 2600 metre standing start event. She alleged that it had galloped for a distance well in excess of 150 metres.

Mr N G McIntyre, Stipendiary Steward, showed a video replay of the first 200-300 metres of the Race. He pointed out THE FAT CONTROLLER, which had drawn Unruly 2 on the front line, pace off the mark (incorrect gait) and then, shortly thereafter, gallop and continue in a gallop to a point past the winning post.
--The Committee was satisfied, based on its viewing of the video replay and the fact that Mr Dunn did not contest the protest, that THE FAT CONTROLLER had broken from its gait at the start of the Race and had failed to promptly regain its proper gait in terms of the Breaking Horses Regulation in that it had continued in a break for a distance of 150 metres or greater.

Accordingly, the protest was upheld and THE FAT CONTROLLER was disqualified from the Race. As a consequence of the disqualification, the amended placings for the Race are:
