ID: JCA20058
Hearing Type (Code):
thoroughbred-racing
Decision: Hearing of Informations 32201, 32202, 32073 & 32203 filed under the Protest Rule 876(1).
--
Protest One:
--Stipendiary Steward, Mr A Coles, alleged interference by SHINKO BAY or its rider, placed first by the judge, interfered with the chances of CRUSADER BELLE, placed second by the judge. (Information 32201).
--Particulars: The alleged interference occurred in the final straight.
----Protest Two:
----Stipendiary Steward Mr A Coles, alleging interference by SHINKO BAY, or its rider, placed first by the judge, interfered with the chances of LA SOLAR ECLIPSE, placed third by the judge. (Information 32202).
--Particulars: The interference occurred in the final straight.
----Protest Three:
----Mr James Hatton, trainer of RAPID RIELLE, lodged a connections protest (Information 32073). Mr Hatton alleged that SHINKO BAY or its rider, placed first by the judge, interfered with the chances of RAPID RIELLE, ridden by Jay Ford, and placed fourth. The Registrar has received an undertaking to pay the filing fee of $100.
----The judge's placings were:
--First : No.2, SHINKO BAY, (D Johnson, A)
--Second: No.5, CRUSADER BELLE, (M Du Plessis)
--Third : No.9, LA SOLAR ECLIPSE, (S Collett, A)
--Fourth: No.7, RAPID RIELLE, (J Ford)
----The official margins were 1-1/4 lengths, nose, 2 lengths.
----The informations were filed with the registrar within the times prescribed under the Rules of Racing.
----All three protests were heard together.
----Present during the hearing were trainers, Messrs. Mr Bill Pomare, Mr G Thomas, Mr McQuade, Mr J Hatton. Also, Mr R Cameron, employer of apprentice Miss D Johnson, and stipendiary stewards and connections.
----Enquiry was made as to whether all connections had been advised of the protest hearing, which was answered in the affirmative.
----Protest One:
----The first issue we must decide is whether there was interference to CRUSADER BELLE by SHINKO BAY.
----In summary, Assistant Stipendiary Steward Mr Williamson demonstrated the alleged incident using the head-on and side-on cameras. He said shortly after entering the final straight LA SOLAR ECLIPSE (S Collett) rolled out and bumped CRUSADER BELLE (M Du Plessis) near the 200 metres (approximate). SHINKO BAY when improving forward on the outside shifted inwards when being ridden with the whip, resulting in tightening to inside horses.
----Mr Du Plessis, rider of CRUSADER BELLE (No.5) asserted he was following SHINKO BAY and that horse moved inwards and dictated his line. He said the interference may have cost him one length. He said he did not stop riding his horse.
----Mr Thomas, on behalf of CRUSADER BELLE, confirmed jockey M Du Plessis' evidence and observations.
----Mr Pomare, on behalf of SHINKO BAY, observed that jockey M Du Plessis was leaning inwards on to the third placed horse LA SOLAR ECLIPSE, prior to his horse "coming in a bit". He pointed out the interference, which occurred between the second and third placed horses prior to his horse moving in. He also asserted that his horse won well and the margin between first and second was 1-1/4 lengths. Mr Pomare said his horse SHINKO BAY was clear of all horses prior to rolling.
----Decision:
----We are satisfied having viewed and reviewed the relevant films and listening to the evidence/submissions that minor interference occurred when SHINKO BAY moved inwards. We find that there was prior interference between the second and third horses, and minor interference caused by SHINKO BAY.
----In terms of Rule 876(1), we next had to consider whether the interference affected the chances of CRUSADER BELLE finishing in a better placing, and take into account the nature of the interference.
----In our view the chances of CRUSADER BELLE were not interfered with. We find the minor interference happened at approximately the 200 metre mark, and note the margin between first and second, namely, 1-1/4 lengths. We also note that SHINKO BAY was strong and convincing.
----Accordingly, the protest is dismissed.
----Protest Two (Information 32202):
----The first issue we must decide is whether there was interference to LA SOLAR ECLIPSE by SHINKO BAY.
----In summary, Assistant Stipendiary Steward Mr Williamson demonstrated the incident on the race videos. He demonstrated some inward movement by SHINKO BAY at approximately the 200-metre mark.
----Miss S Collett (A), rider of LA SOLAR ECLIPSE, asserted her mount suffered interference at the 200 metre mark. She said jockey M Du Plessis was leaning in on her mount slightly. Mr McQuade, trainer, confirmed Miss Collett's evidence.
----Mr Pomare, on behalf of SHINKO BAY, asserted jockey M Du Plessis was leaning inwards on to the third placed horse LA SOLAR ECLIPSE prior to his horse "coming in a bit". He said that his horse was clear of all horses prior to rolling in. Mr Pomare emphasised the incident was alleged to have happened approximately 200 metres from the finishing line.
----We are satisfied having viewed/reviewed the films/evidence/submissions that minor interference occurred when SHINKO BAY moved inwards.
--In terms of Rule 876(1) we next have to consider whether the interference affected the chances of LA SOLAR ECLIPSE finishing in better placings, and must take into account the nature of the interference, in this case minor. In our view the chances of LA SOLAR ECLIPSE were not interfered with, and have taken into account the margins of 1-1/4 lengths and a nose. We find that minor interference occurred at the 200 metres.
----Accordingly the protest is dismissed.
----Protest Three (Information 32073:
----This is a connections protest.
----The informant, Mr J Hatton, alleged that SHINKO BAY or its rider, placed first by the judge, interfered with the chances of RAPID RIELLE (No.7), placed fourth by the judge.
----Official margins: 1-1/4 lengths, nose, two lengths.
----Mr J Hatton, Trainer, asserted that his horse had received interference from SHINKO BAY. Jockey J Ford said his mount suffered interference.
----Mr Pomare repeated his earlier evidence.
----Mr A Coles' assessment was that RAPID RIELLE was weakening at the time of interference.
----Decision:
--We are not satisfied that SHINKO BAY caused interference to RAPID RIELLE (No.7).
----Accordingly the protest is dismissed, and we direct a refund of the filing fee, if paid.
----………………………………………………
----At the completion of these protest hearings we were advised by Mr A Coles that there was a further protest. Mr Coles advised that Mr McQuade, trainer of the third horse, had lodged a protest against the second horse.
----We were advised that Mr McQuade had given notice of intention to protest within the requisite time and informations had been filed. This was confirmed by Mr Coles and Mr McQuade.
----Mr McQuade alleged that CRUSADER BELLE, or its rider, placed second by the judge interfered with the chances of LA SOLAR ECLIPSE, placed third by the judge.
----The official margins between third and second is a Nose.
----Present during the hearing were the connections/trainer/jockeys.
----Mr McQuade said that his horse received interference and received a bump from CRUSADER BELLE.
----Stipendiary Steward Mr A Coles, made an assessment of the alleged incident. He said that there was movement inwards and outwards by both horses.
----We find that both horses contributed to the interference at about the 200-metre mark.
----Decision:
--We are not satisfied that CRUSADER BELLE caused interference to LA SOLAR ECLIPSE. The protest is dismissed.
----Direction:
--That the filing fee be refunded.
