Mr Laking admitted a breach of rule 520(4)(c) in that he failed to make the contract weight for two rides: BOWLEMOVA in race 2 and SAM’S INDIAN in race 5. We thus find the charge proved. This was Mr Laking’s first day back riding in New Zealand after a suspension in Australia.
----We are aware that Mr Laking has an issue with weight but this is his first breach for almost a year. Mr Ching suggested that he be treated as a first offender as Mr Laking has successfully been able to ride at the required weights in both Australia and New Zealand this year. He asked for a fine in the range of $100 to $200.
----We take into account it was two rides that Mr Laking was unable make and that satisfactory replacement riders were able to be found and, in particular, his ready admission of the breach and his co-operation with the stewards prior to race one. We accept that the matter can be dealt with today as if Mr Laking was a first offender. He is fined the sum of $200 and reminded of the need to carefully watch his weight over the festive season.
