Decision:
At the completion of Race 6, the Christian Fire at Stud Mobile Pace (Junior Drivers), a protest was lodged by Stipendiary Steward Mr N McIntyre under rule 869(8) against the 2nd placed horse by the judge CARDINAL HUFF (B Munro) alleging that with approximately 300m to run in the race CARDINAL HUFF struck the wheel of JADE BROMAC driven by junior horseman A Sanderson.

--Rule 869 (8) states “The Judicial Committee may in addition to any other penalty which may be imposed pursuant to rule 1003 thereof place any horse which -
(a) may have gained an advantage by any conduct or interference prohibited by any preceding provision of this rule and/or
(b) may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses-
immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby”
Mr Munro was assisted throughout the hearing by senior horseman Mr C Thornley and Mr Sanderson was assisted initially by senior horseman Mr B McLellan and shortly after by Mr K Larsen, the trainer of JADE BROMAC.
--Mr McIntyre showed the committee several video clips of the alleged incident highlighting CARDINAL HUFF moving out from the trailing position and striking the wheel of JADE BROMAC who was leading with about 300m to run. Mr McIntyre stated that as a result of the striking of the wheel the sulky tyre on JADE BROMAC had come adrift and had hampered JADE BROMAC finishing in a closer position.
--Mr Thornley in assisting Mr Munro stated that Mr Munro was entitled to move out when and where he did and that the horse racing wider on the track FIERY RASCAL driven by M Williamson moved inwards contributing to the incident.
--Mr Larsen assisting Mr Sanderson stated that it was clear from the video footage that CARDINAL HUFF had struck JADE BROMAC’s sulky wheel and that the horse’s chances were affected. Mr Larsen also stated that JADE BROMAC had lead throughout the race which was run at a “fast clip” (last quarter in 28 seconds) and for the horse to run third carrying a sulky tyre that had come adrift was a great effort. It was noted that the distance between the 2nd and 3rd placed horses at the finish of the race was 1.5 lengths.
--Decision
--The protest was upheld with the 2nd placed horse CARDINAL HUFF being relegated to 3rd place and JADE BROMAC being promoted from its 3rd placing to 2nd place. The committee was satisfied that CARDINAL HUFF had moved out and struck the wheel of JADE BROMAC who was in the leading pole line position with about 300m to run. Clearly JADE BROMAC’s chances of finishing in a higher placing were affected.
--The committee was also satisfied that no other horse or horseman contributed to the incident.
