Following race 9 , the New World Whakatane 1200, a protest was lodged by Stipendary Steward Mr A Coles alleging that DAB, or its rider, placed 2nd by the judge, interfered with the chances of SAINT ZEDE, placed 3rd by the judge. The interference occurred in the final straight.
--The judges placings were: 1st VICTORY CROSS
--2nd DAB
--3rd SAINT ZEDE
--The margins were ? of a length between 1st and 2nd, and ? of a length between 2nd and 3rd.
--The information alleged a breach of rule 876(1)
--Present at the hearing were Mr & Mrs J A Gibbs, owners of DAB, and jockey Mr B Lammas.
--Representing SAINT ZEDE were Mr C J Wood, part owner and trainer, and jockey Mr M Hills.
--Mr Coles reserved the right to charge Mr Lammas.
--Mr Hills, the rider of SAINT ZEDE, said that as he came down the straight he was racing on the hind quarters of the leader, VICTORY CROSS, with Mr Lammas on his inside. He said he was keeping Mr Lammas in his position on the fence which he was entitled to do. He said that at least twice Mr Lammas tried to get out from off the rails. In doing so SAINT ZEDE was knocked off balance each time and Mr Hills said that with the loss of momentum he felt that he had lost at least 1 ? lengths.
--Mr W Robinson demonstrated the videos. He showed where Mr Lammas' 1st attempt to make a gap was unsuccessful, but he did make contact with Mr Hills and put SAINT ZEDE off balance.
--In his 2nd attempt he was more successful in getting through, but not before he made heavy contact with SAINT ZEDE again.
--The 3rd contact was just before the winning post.
--Mr Woods supported Mr Hills evidence while Mr Gibbs had nothing to add.
--DECISION:
--We are satisfied that, with approximately 200 metres to run, SAINT ZEDE did suffer bad interference on two occasions when DAB tried to force a gap when not entitled to. The subsequent interference caused SAINT ZEDE to suffer loss of balance and momentum.
--We have exercised our discretion and considered whether the interference affected the chances of SAINT ZEDE finishing in a better place.
--After taking into account the level of interference including the loss of balance and loss of momentum suffered by SAINT ZEDE, the manner in which both horses were finishing the race, and the ? length margin we uphold the protest.
--The placings are now: 1st 4 VICTORY CROSS
--2nd 6 SAINT ZEDE
--3rd 9 DAB
