Rule 870 (5) : Following the running of race number 3 an information was lodged by the Stipendiary Stewards instigating a protest against Live Achiever horse number 2 placed 4th by the Judge on the grounds that at the finishing line it was in its incorrect gait and lapped on by Precious Amrik horse number 6.

Mr Feast, the owner/trainer of Live Achiever was present at the hearing and indicated to the Committee that the protest was not contested.

The Stipendiary Stewards advised the Committee that Live Achiever who had been pacing roughly left its stride and was in its incorrect gait at the finishing line when lapped on by Precious Amrik. This was confirmed by video evidence and photo finish print out shown to the Committee. The Stipendiary Stewards sought relegation only.

The protest is, accordingly, upheld and Live Achiever is relegated from 4th place to 5th place and Precious Amrik promoted from 5th place to 4th place. The amended placings read 5, 7, 9, 6, 2, 14.
