Decision:

Following Race 10 an Information was filed pursuant to Rule 876(1) when it was alleged by the informant, Stipendiary Steward Mr AR Coles, that GALLIONS REACH, placed 1^st by the judge, interfered with the chances of STABINTHEDARK placed 2^nd by the judge.

Following Race 10 an Information was filed pursuant to Rule 876(1) when it was alleged by the informant, Stipendiary Steward Mr AR Coles, that GALLIONS REACH, placed 1^st by the judge, interfered with the chances of STABINTHEDARK placed 2^nd by the judge. The alleged interference took place in the final straight. The margin between 1^st and 2^nd was three-quarters of a length.

GALLIONS REACH was represented by Mr CM JilIings and rider, Mr R Norvall.

STABINTHEDARK was represented by Mr A Gibbs, and rider Ms C Tremayne.

Mr Coles reserved the right to charge Mr Norvall.

Mr J Oatham demonstrated the incident on race videos. The head-on view showed GALLIONS REACH attempting to make a run between STABINTHEDARK and SOL INVICTUS. He showed the initial contact when GALLIONS REACH tried to force a gap. He showed where, in his view, contact was made at least four times when GALLIONS REACH was forcing his way through when there was insufficient room. Mr Oatham also said that in his opinion if Mr Norvall had met his obligations and not forced his run his chances of success would have been lessened.

Mr Gibbs pointed out that STABINTHEDARK maintained a straight line except when contact was made. He pointed out that in the final stages once STABINTHEDARK had regained balance he was gaining on GALLIONS REACH.

Mr Jillings, in defence of GALLIONS REACH, demonstrated the side-on video which, he claimed, showed STABINTHEDARK had contributed to the closing of the gap.

DECISION:

The committee, after reviewing all evidence are satisfied that GALLIONS REACH did come between SOL INVICTUS and STABINTHEDARK when there was insufficient room and did make contact on several occasions.

The committee was satisfied that STABINTHEDARK did suffer subsequent interference and his chances of finishing in a better place were affected.

In exercising their discretion, the committee, took into account the severity of the interference and the manner in which STABINTHEDARK, after regaining balance, finished the race strongly.

The protest was upheld and the amended placings are now :-
