Ms Myers was charged with careless riding under Rule 871 (1) (d) following her ride in Race 2.



Ms Myers was charged with careless riding under Rule 871 (1) (d) following her ride in Race 2. The information alleged that Kelly Myers the rider of Mitzi has allowed her mount to move inwards when not the required distance clear causing interference to Minnaki ridden by Lynsey Hofman at the end of the back straight.

Ms Myers did not admit the breach. Senior rider Mr B.Herd assisted her at the hearing.

Mr Goodwin called Ms Hoffman to give evidence. She told the committee that she was traveling nicely along on the fence with Ms Myers three out and going forward. Mr Innes was racing between them. Ms Myers, when moving towards the rail, crossed in front of her when only three-quarters to one length clear and as a result Ms Hoffman had to check her mount which caused her to lose about one length of ground.

Mr Goodwin asked Mr Bateup to show all the available films of the incident. He pointed out the inward movement of Ms Myers first of all crossing in front of Mr Innes when only marginally clear and then in front of Ms Hoffman when only one and one-quarter lengths clear. He said in his opinion the side-on film clearly showed Ms Hoffman having to check her mount as a result of Ms Myers not being the required distance clear.

Mr Herd submitted that the race had been run at a muddling pace with a small field of two year olds. He said that Ms Myers did her best to keep her horse straight as it was inclined to roll inwards. She cleared Mr Innes but as she got to the front and over towards the rail her horse eased up and lost some momentum. He said that the other horse already had its head up in the air before she crossed it.

Ms Myers told the committee that her horse was very green and it got a bit lost when it went past Mr Innes. She thought at all times she was clear of both Mr Innes and Ms Hoffman.

DECISION

--

The committee had careful regard to all of the submissions put before it. There was no dispute that interference had occurred to Minnaki (Ms Hoffman) and the evidence of Mr Bateup and Ms Hoffman stated that Ms Myers was not the required distance clear when she crossed over towards the rail.

Ms Hoffman said that the only reason she had to take a hold of her mount was because Ms Myers crossed in front of her.

--

The fact that it was a two year old race and that Ms Myer's mount was "green" does not absolve her of her responsibilities to ensure that she rides within the Rules of Racing.

The charge of careless riding was found to be proved.

PENALTY

--

Mr Goodwin told the committee that Ms Myers had only one previous charge of careless riding, at Awapuni on 10/12/05 for which she received a three-week suspension. He suggested that this breach be met with a term of suspension.

Mr Herd asked that the committee take into consideration Ms Myer's excellent riding record, the full-book of rides she has at most meetings and that this was a minor error of judgment in a two year old race.

In coming to a decision on penalty the committee took into account:

  • The large number of rides that she has
  • --
  • The fact that her mount was inexperienced and racing amongst other inexperienced horses.

It was our opinion that a suspension was the appropriate penalty. For safety reasons it is imperative that riders always ensure that they are the required distance clear before they cross over in front of other runners.

Ms Myers was suspended from the conclusion of racing on Wednesday April 26th until the conclusion of racing on Sunday April 30th, in effect three days.
