An Information instigating a protest was lodged by Stipendiary Steward Mr T TAUMANU on behalf of the connections of Horse 10 METEKHI (G. SMALL) placed 8th by the Judge against Horse 1 DYNAMIC DUDE (D BUTCHER), placed 1st by the Judge.

An Information instigating a protest was lodged by Stipendiary Steward Mr T TAUMANU on behalf of the connections of Horse 10 METEKHI (G. SMALL) placed 8th by the Judge against Horse 1 DYNAMIC DUDE (D BUTCHER), placed 1st by the Judge.
--Mr S DUNLOP part owner and Driver D Butcher represented the interests of Dynamic Dude and Mr Small, Driver and Trainer of Metekhi was present for Metekhi.
----Mr Taumanu referred to video tapes of the start of the race and indicated that Dynamic Dude had paced roughly at the start before breaking causing Metekhi to come into contact with his sulky and break up losing approx eight lengths.
----Mr Butcher said that Dynamic Dude had gone roughly from the gate and although it hadn?t been severe he had been slow out of the gate. He said his horse had not broken and felt that Mr Small may have been travelling too closely and had contributed to the contact made.
----Mr Small said that he was trailing up pretty close behind Dynamic Dude and caught up pretty quickly. He admitted that he may have been too close and had contributed to the interference.
----Mr Taumanu submitted that if Dynamic Dude hadn?t gone roughly at the start then Mr Smalls Drive would not have broken.
----Mr Small suggested that if his drive had finished in a better position he may have been more critical of the interference. Both he and Mr Butcher accepted they had contributed to the interference
----Decision
----I am satisfied from viewing the Video tapes and listening to the evidence submitted that Dynamic Dude Ran roughly at the Start of Race 8 and was subsequently slow in starting. The Horse did not break and Mr Small anticipating the field moving forward had been travelling too closely behind Mr Butcher and had struck the Sulky wheel or Dynamic Dude causing his horse Metekhi to break.
----Both drivers have agreed their drives contributed to the contact made and the subsequent effect on the chances of Metekhi
----I find insufficient fault on the part of Dynamic Dude to support the protest and it is dismissed accordingly. The Judges places will stand.
