Decision:

An information was lodged under Rule 330 (3) (c) alleging that B Lammas failed to make the carded weight for SIR COSWORTH in Race 5.



An information was lodged under Rule 330 (3) (c) alleging that B Lammas failed to make the carded weight for SIR COSWORTH in Race 5.

Mr. Lammas admitted the breach.

Mr. Goodwin began by saying that Mr. Lammas had a very good record under this rule considering the large number of rides that he has.

His record shows three charges in the past 12 months:

5/9/09  Wanganui  $200
20/6/09 Tauranga  $200
21/3/09 Riccarton  $200

--


The Stewards submission was for a monetary penalty in the vicinity of $300.00.

Mr. Lammas said that he was a kilo overweight today but felt that he had been hindered by a cold in the days leading up to today’s race meeting and the illness had affected his ability to lose weight.   The lightest he can ride at is 53 kilos which takes a lot of effort under normal circumstances.

In coming to a decision on penalty we had regard to all of the submissions.

--

Mr. Lammas was replaced on SIR COSWORTH by Mr. R. Hannam due to being a kilogram overweight. The committee accepts that his cold may have made it more difficult to get down to the correct weight but we did not agree with the Stewards opinion that his record under this rule was a very good one. He has incurred three charges in the past 8 months.

--

Mr. Lammas is a leading rider with a high public profile. He was reminded that he should not be accepting lightweight rides if he was struggling to make the weight and was warned that further breaches may well be dealt with by way of suspension.

--

On this occasion Mr. Lammas was fined the sum of $350.00.
