Following race 10 an information was filed pursuant to Rule 871(1)(d) by the informant, Mr J Oatham. He alleged that Mr J Waddell angled his mount SHI KIN FLY outwards near the 200 metres when not sufficiently clear of SHESAKEEPER (S Collett) who was checked causing TRUE EMOTIONS (J Jago) to also receive a check.
DECISION & REASON:
--Following race 10 an information was filed pursuant to Rule 871(1)(d) by the informant, Mr J Oatham. He alleged that Mr J Waddell angled his mount SHI KIN FLY outwards near the 200 metres when not sufficiently clear of SHESAKEEPER (S Collett) who was checked causing TRUE EMOTIONS (J Jago) to also receive a check.

Mr Waddell pleaded guilty to the charge.

Mr M Williamson, Stipendiary Steward, demonstrated the videofilms and showed where at approximately the 200 metre mark Mr Waddell riding SHI KIN FLY angled his mount out for a run when the gap in front of him closed. However, in doing so he moved into the line of SHESAKEEPER when only ¾ length clear of that runner. Miss Collett had to check her mount which caused her to come back onto TRUE EMOTIONS which also had to be checked.

Mr Waddell said he was denied the run ahead and as those horses were stopping he moved out to avoid their heels, but admitted he was not clear of Miss Collett in doing so.

PENALTY:
--Mr Oatham produced Mr Waddell’s record which showed 2 recent suspensions of 5 days each. He submitted this offence warranted a 4 day suspension.
--Mr Waddell said he had commitments up until 22 November.

The Committee considered all submissions and before imposing a fair penalty took into account the following:
--1. Mr Waddell’s guilty plea.
--2. His record.
--3. Degree of carelessness.
----
Normally this offence would warrant a 5 day suspension, but in this case we have given Mr Waddell a 1 day concession after taking into account his guilty plea and the fact he will miss a premier day on 28 November at Otaki.
----
Accordingly we impose a suspension to start after racing on 22.11.08 and conclude after racing on 28.11.08 (4 days).
