An information instigating a protest filed by Stipendiary Steward Mr J. Muirhead on behalf of KAHUNA BROMAC driven by Mr P Ferguson place 3rd, DEIMOS driven by Mr S Reid placed 4th and ATTENTION SEEKER driven by Mr A Neal placed 5th against EXCEPTIONAL CULLEN driven by Mr A Herlihy placed 1st, on the grounds of interference in the last 50 metres of the race. The drivers represented the connections of the respective horses.
--Mr Muirhead showed the video films of the last 50 metres of the race. EXCEPTIONAL CULLEN was leading. KAHUNA BROMAC was inside EXCEPTIONAL CULLEN, DEIMOS inside KAUNA BROMAC and ATTENTION SEEKER on the marker pegs inside DEIMOS. EXCEPTIONAL CULLEN moved inwards and tightened the other three horses affecting their progress. Mr Neal had to strongly restrain his horse just before the finishing line. EXCEPTIONAL CULLEN won by half a head from NAPOLEAN DYNAMITE which fnished wide out on the track. There was a length and a quarter back to KAHUNA BROMAC, a neck to DEIMOS and a head to ATTENTION SEEKER.
--Mr Ferguson and Mr Reid said their chances of finishing in a higher placing were not affected. Mr Neal said it was marginal whether or not the chances of ATTENTION SEEKER finishing 4th were affected.
--DECISIONS AND REASONS:
--The inward movement by EXCEPTIONAL CULLEN caused interference to the other three horses and affected their progress. However the committee is satisfied that the chances of KAHUNA BROMAC, DEIMOS and ATTENTION SEEKER finishing in a higher placing were not affected. The committee exercises its descretion to not uphold the protest. The protest is dismissed and the judges placings stand.
