Decision: Following the running of Race 5, the Bennetts Station Mobile (PBD) Trot, an information was laid by Stipendiary Steward Mrs K. R. Williams against Mr J. M. Gray, the driver of “Dontgobreakinmyheart” (11), alleging that he had committed a breach of Rule 869(2)(a) in that he had used his whip excessively in the run home.

Following the running of Race 5, the Bennetts Station Mobile (PBD) Trot, an information was laid by Stipendiary Steward Mrs K. R. Williams against Mr J. M. Gray, the driver of “Dontgobreakinmyheart” (11), alleging that he had committed a breach of Rule 869(2)(a) in that he had used his whip excessively in the run home.

Mr Gray is a Junior Horseman but advised that he did not need assistance. He had indicated on the information that he admitted this breach of the Rules and he confirmed that at the hearing.
----
Video coverage of this incident was shown to illustrate that Mr Gray had used his whip continuously on about 17 occasions in the run home.

In relation to penalty Mrs Williams advised that Mr Gray had no previous convictions, and that a fine of $200-00 would be appropriate. However Mr Gray had advised that he would prefer a suspension. Mrs Williams then recommended a two days suspension as an alternative to a fine. Mr Gray confirmed that he would prefer a suspension.

In determining an appropriate penalty I was satisfied that a two days suspension was appropriate in this case. Accordingly Mr Gray was suspended from after the completion of racing today (10 June 2008) until after the completion of racing on 15 June 2008, which is effectively a two days suspension.
