Rule 876(1) was read and understood by all parties.

The Judges placings were 1st #7 CULLEVER
--2nd #3 ANAHERA
--3rd #1 OUR SISTER
--4th # 5 FUJI EXTREME
--The margin between 1st and 2nd was a half length.
--Mr Doyle used the head and side on films to demonstrate the alleged incident where approximately 75 metres from the finish, CULLEVER on the outside of ANAHERA moved inwards making contact with ANAHERA causing a severe check. Mr Donovan added Mr Todd was riding his horse hard and Mr Doyle was pushing ANAHERA who was not given a chance to run the race out after the interference.
--Mr Todd said after getting alongside ANAHERA his mount CULLEVER edged away by 3 or 4 strides and was pulling away when he ducked in suddenly, we have made contact and I have pulled off immediately.
--Mr French confirmed his horse was travelling well until it ducked in.
--Mr Goodwin under the rule allowed ,commented that it was clear ANAHERA did receive a sharp check from CULLEVER but at that stage had been mastered by that horse and did not believe the chance of ANAHERA finishing in a higher placing had been affected.

Rule 876(1)
--If a placed horse or its rider causes interference within the meaning of this rule 876 to another placed horse, and the Judicial Committee is of the opinion that the horse interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with.
----
After hearing all the evidence and viewing the films available the committee accepts there was interference at approximately seventy-five metres from the winning post by CULLEVER with a sudden inward movement and contact was made. The committee has to be sure that had ANAHERA had a clear run to the line it would have beaten CULLEVER. With the greater momentum at the time of the incident and although the sudden movement inwards did hamper ANAHERA. CULLEVER was finishing the better and taking the margin of one half length at the line. The committee are not convinced that ANAHERA would have finished ahead of CULLEVER and therefore the protest is dismissed and the placings as called by the Judge stand.
