Mr Knowles, stipendiary steward, alleged that approximately 100 metres from the finish CUTIE PATOOTIE (C Middleton) broke from its gait and galloped across the finish line in breach of the Breaking Horse Regulations and R 870(3). He sought disqualification.

Judge’s placings were: 6; 3; 10; 12; 1, 9.

Mr Allison demonstrated that CUTIE PATOOTIE broke for approximately 100 metes in the home straight and was still galloping when it crossed the line. Mr Middleton did not dispute that the horse should be disqualified.

--

We are satisfied that CUTIE PATOOTIE was in breach of the Breaking Horse Regulations and, as a consequence, R 870(3). We exercise our discretion and disqualify CUTIE PATOOTIE from 5th place.
