Following the running of Race 2, World Driving Championship Heat Mobile Trot, an information was filed by Chief Stipendiary Steward, Mr N R Escott, instigating a protest against JUST A MOMENT (Andy Miller), placed 9th by the judge, on the ground of breaking from its gait during the running and failing to promptly regain its proper gait.

Mr M J Smolenski, trainer of JUST A MOMENT, had signed the information acknowledging receipt of it and the Committee was informed that Mr Smolenski did not wish to be present at the hearing of the information.

Mrs K R Williams stated that it was alleged that JUST A MOMENT had broken from its gait during the running of the Race and had continued in the break for approximately 400 metres. Mrs Williams said that the Stipendiary Stewards were seeking disqualification of the horse. The final placings of all runners were relevant, she said, because the Race was an event in the World Driving Championship and points were allocated to the drivers according to finishing places.

Video replays of the Race were shown to the Committee by Mr N G McIntyre, Stipendiary Steward. He pointed out JUST A MOMENT go into a gallop with approximately 1500 metres to run and continue in a gallop for approximately 400 metres, in excess of the distance of 150 metres referred to in the Breaking Horses Regulation.

The Committee was satisfied that JUST A MOMENT had broken from its gait during the running and had continued in a gallop for 150 metres or greater and was, therefore, in breach of the Breaking Horses Regulation and had failed to promptly regain its proper gait.

Accordingly, the protest was upheld and JUST A MOMENT was disqualified from the Race.
