Under Rules 869 (7a) (c) 869 (4) : An information was filed instigating a protest following the running of Race no 7, the informant was Stipendiary Steward Mr J M Muirhead.
--This was a protest by horse No 1 WONDERLAND, driven by Junior Horseman Mr V Blanchard, placed 6th by the judge against horse no 2 WHODATDARE driven by Mr I J Brownlee, placed 2nd by the judge.

--Present at this hearing was Mr V Blanchard, Jr Horseman, represented by Mr P C Ferguson and Mr I J Brownlee.
--Mr Muirhead opened his evidence by calling Stipendiary Steward Mr T W Taumanu, who stated that after the start of this race he observed Mr Brownlee (WHODATDARE ), racing in the parked position outside of Mr Blanchard’s drive (WONDERLAND). Mr Taumanu said that Mr Brownlee was following Mr Mangos (SCORPIO VANCE) and when Mr Mangos went to the lead Mr Brownlee followed him and in doing so forced WONDERLAND over the marker pegs for some distance.
--Mr Taumanu stated there was some very bad language from both Mr Blanchard who had called for room and also from Mr Brownlee.
--Mr Taumanu was adamant the actions of Mr Brownlee were in breach of the rules and Mr Brownlee had forced Mr Blanchard’s drive over the marker pegs as the field raced into and around the first bend.
--Mr Muirhead showed the video of this incident and this clearly showed WONDERLAND, Mr Blanchard being forced over the marker pegs for some distance by Mr Brownlee coming inwards and causing his line to be dictated.
--Mr Blanchard when asked why he had been forced over the marker pegs stated that the pressure had come from Mr Brownlee and he had caused WONDERLAND, to be put over the marker pegs.
--Mr Brownlee gave evidence and stated that Mr Blanchard could have pulled back. Mr Brownlee also stated that this sort of thing has happened to him on numerous occasions. Mr Brownlee considered that Mr Blanchard had forced the position and put himself in the position of going over the marker pegs.
--Mr .Muirhead sought relegation of WHODATDARE from its 2nd placing as he considered that this horse had broken the rules by forcing its way into the trail when not entitled to do so.

Decision and Reasons :
--Having heard the evidence of Mr Taumanu, Mr Muirhead, Mr Blanchard and Mr Brownlee and having also viewed the video of this incident I find that there has been a clear breach of Rules 869 (7a) (c) and 869 (4) by Mr I J Brownlee when he forced Mr Blanchard over the marker pegs and gained the trail behind SCORPIO VANCE .
--The video evidence is very clear that the actions of Mr Brownlee in forcing WONDERLAND over the marker pegs did interfere with the progress of WONDERLAND and cause interference to this runner.
--The evidence of Mr Brownlee was unconvincing.
--The protest is upheld and I order under the provisions of Rule 1003 that WHODATDARE the horse which caused the interference to WONDERLAND after the start be disqualified from its 2nd placing in race no 7.
--The amended placings shall now read 1st No 5, 2nd No 4, 3rd No 3, 4th No 6, 5th No 1, 6th No 7.
