Charge:
--Following the running of Race 4, the Teltrac Communications Handicap, an Information was filed by Stipendiary Steward Mr M. Davidson against Licensed Jockey Mr J. S. Bullard under Rule 638(1)(d) alleging careless riding.
----
The information reads as follows.
----
“I the abovenamed informant allege that the abovenamed Defendant committed a breach of Rule 638(1)(d) in that J. Bullard rider of Grand Rapids permitted his mount to shift inwards near the 200ms when not clear causing crowding to the following – Missceo (K. Williams) Prince Dane (K. Walters) Noble Court (L. Allpress) and Lotus (C. Lunn).”

Rule 638(1)(d) reads as follows.

“(1) A rider shall not ride a horse in a manner which the Judicial Committee considers to be:
--(a) …..
--(b) …..
--(c) …..
--(d) careless…”

Mr Bullard had indicated on the Information that this breach of the Rules was admitted. He also agreed that he understood the charge and the Rule it was brought under.

Facts:
--Stipendiary Steward Mr McLaughlin gave evidence and used video coverage to show that at about the 200 metre mark “Grand Rapids” was allowed to shift inwards when being ridden with the whip, and that the line of “Missceo” was dictated, with resultant crowding to three other horses which were racing inside “Missceo”.

Mr Bullard accepted the facts as presented by the Stipendiary Stewards.

Decision:
--As this breach was admitted it was deemed to be proved in accordance with Rule 915(1)(d).
----
Submissions on Penalty:
--In relation to penalty Mr Davidson advised that Mr Bullard had breached this Rule on three previous occasions. On 6 February 2010 at Wingatui (a Premier day) there were two breaches when he received a suspension for a total of one month (Mr Bullard thought). There was a further breach on 23 May 2010 at Wingatui when Mr Bullard received a five day suspension.

Mr Davidson assessed this breach as being “mid-range” and submitted that a suspension of three South Island days would be appropriate. Mr Bullard did not seek to delay the commencement of this suspension.

There was a discussion about whether Mr Bullard rode in the North Island. He advised that he did ride in the Central Districts on occasions, and that he had ridden up there about three weeks ago. Mr Davidson then made submissions that if North Island days were to be taken into account then a suspension of no less then four days should be imposed, but in any event the suspension should not exceed two weeks.

Mr Bullard said that he thought the submissions made by Mr Davidson as to penalty were fair.

We adjourned to consider the matter of penalty.

Reasons and Penalty:
--To Mr Bullard’s credit we took into account his admission of the breach, and also that the breach was mid-range. On the other hand we also needed to take into account that this was Mr Bullard’s fourth breach for careless riding since February 2010.
----
We decided that race days in the Central Districts should be taken into account as part of a suspension, and that a suspension of four riding days would be appropriate. On returning to the Enquiry Room we advised the parties that Mr Bullard’s Jockey’s Licence was suspended from after the completion of racing today, the 24 September 2010, until after the completion of racing on 7 October 2010, this being a four day suspension.

The specific days of this suspension are Woodville-Pahiatua on 30 September, CJC on 2 October, Southland on 3 October and Otaki Maori on 7 October 2010.
