This was an information filed by Ms Williams, stipendiary steward, alleging that Mr McEvoy (CHOCOLATTO) drove carelessly when shifting wider on the track with approximately 500 metres to run checking IN DEFAULT, which lost all chance.
--Mr McEvoy admitted the breach, which we thus find to be proved.
--Ms Williams has demonstrated that when FALSE PROMISE, driven by Mr Coutts and which was racing 2 back on the fence immediately in front of Mr McEvoy, began to tire, Mr McEvoy moved out into the running line of Mr May. Mr May’s horse IN DEFAULT broke as a consequence.
--Mr McEvoy has stated that CHOCOLATTO was giving him a difficult drive. Ms Williams accepted this but stated that this was prior to the incident in question. She asked for a suspension of 4 to 6 weeks.
--We accept that CHOCOLATTO was giving Mr McEvoy a difficult drive. He stated when CHOCOLATTO saw daylight outside FALSE PROMISE the horse moved out. He also stated that CHOCOLATTO had a dead mouth and as a consequence was proving extremely difficult to control.
--We accept Mr McEvoy was having a difficult drive but we are in no doubt that he could have eased back when FALSE PROMISE tired. That horse was stopping gradually. Mr McEvoy had time to ease back. He indicated he had 2 horses qualified for raceday and that the bulk of his experience was at trials. He had had about 10 raceday drives and had a clear record. Balancing these matters, we believe a suspension of just over 4 weeks is appropriate. Mr McEvoy is suspended from driving at the end of today’s meeting up to and including 13 February. This will permit Mr McEvoy to drive at the Waikouaiti meeting on the Sunday 14 February.
