An information lodged by Stipendiary Steward Mr T Taumanu against Mr L Hollis, driver of MARIA?S REIGN, placed 8th by the Judge, alleging a breach of Rule 869 (3)(b) ? careless driving, in that he caused a severe check to LUNAR SANDS, driven by Mr M White, and placed 10th by the Judge, late in the run home. Mr Hollis admitted the breach and was present at the hearing.

Mr Taumanu demonstrated the incident by use of the video film. Entering the home straight, MARIA?S REIGN was trailing the leader and LUNAR SANDS was trailing MARIA?S REIGN. Mr Hollis did not take immediate use of the passing lane. Mr White moved LUNAR SANDS into the passing lane and improved up on the inside of MARIA?S REIGN. Mr Hollis then moved MARIA?S REIGN into the passing lane. The two horses raced in very tight quarters for the rest of the race and shortly before the finishing line, the two sulkies locked wheels. Mr White was entitled to use of the passing lane and Mr Hollis was clearly at fault.

PENALTY

Mr Taumanu suggested a two day suspension. He said Mr Hollis had a clear driving record. Mr Hollis accepted the submissions of Mr Taumanu. He reminded me of his good driving record. He confirmed to me that he preferred a suspension rather than a fine. In fixing penalty I took into account the following :

  3. The submissions of Mr Taumanu.
  4. --
  5. The submissions of Mr Hollis.
  6. --
  7. The clear driving record of Mr Hollis.
  8. --
  9. The offending was mid range on the scale of seriousness.

Balancing those matters, I suspended Mr Hollis's horsemans licence for two days, commencing at the end of racing on the 29th December and concluding at the end of racing on the 5th of January 2007.
