This is a protest lodged by K Zimmerman, trainer, alleging interference by ANDEN placed second by the Judge affecting the chances of LORD ASTERIX placed third by the Judge in respect of the Hamilton Caterers 2000 on 2.4.05 at Te Rapa. The Judge's placings and the margins were:

The protest was lodged pursuant to Rule 876(1) and seeks relegation of ANDEN. It was lodged in accordance with rule 1107(2) within two minutes of the last to be weighed in of the riders of the horses placed by the Judge being weighed in.

The first question which we are required to consider is whether:

--

LORD ASTERIX was interfered with and whether ANDEN caused that interference as alleged.

--

The Committee heard evidence from the trainer of LORD ASTERIX, Ms K Zimmerman and her jockey, Jade Rogers. Ms Zimmerman said that ANDEN had moved out causing severe interference to LORD ASTERIX and causing her horse to become unbalanced and moved sideways. Jockey Rogers confirmed the evidence of K Zimmerman. Ms Zimmerman said that her horse would have finished second.

Mr Sweeney, rider of ANDEN, gave evidence that the interference was minor and emphasized the interference happened close to the line and that his mount, ANDEN, finished strongly.

The Committee viewed the head-on and side-on videos of the alleged incident. Mr Sweeney emphasized the margin of ? length between second and third.

--

We are satisfied that minor interference occurred. It is then necessary for us to consider whether that interference interfered with the chances of LORD ASTERIX. It is relevant to this consideration that the interference was close to the finishing line, the margin was ? length, ANDEN finished strongly contrasted to LORD ASTERIX battled. Hence we find that the chances of LORD ASTERIX finishing in a higher placing were not interfered with by the interference of ANDEN.

It is therefore our considered opinion that ANDEN should not be relegated. The protest is dismissed. Placings as the horses crossed the line.

We order that the sum of $100 be refunded.
