This is an information filed by Stipendiary Steward Mr. T TAUMANU against Junior Horseman Mr. R. ARGUE driver of MYMUMDIDNOTWANTME alleging a breach of the above rule in that he failed to have his horse into its barrier position of 7 on the second row behind the mobile gate prior to the start.

This is an information filed by Stipendiary Steward Mr. T TAUMANU against Junior Horseman Mr. R. ARGUE driver of MYMUMDIDNOTWANTME alleging a breach of the above rule in that he failed to have his horse into its barrier position of 7 on the second row behind the mobile gate prior to the start.

Mr. ARGUE admits the breach and is present at the hearing and is assisted by Senior Horseman Mr. D, BALLE.

Mr. TAUMANU showed the film of the incident.  MYMUMDIDNOTWANTME was 3 – 4 lengths out of position when the race started.  There was no horse immediately in front of it on the front row.

Mr. ARGUE said the starter had told him prior to the score up to make sure he did not get ahead of other horses on the second row and as a result he got over cautious.  Mr. BALLE said the horse had been lazy in the run up and Mr. ARGUE had made an error of judgement.

PENALTY

Mr. TAUMANU said the recommended starting point was a fine of $250.  He said Mr. ARGUE had no relevant breaches of the rules recorded against him and the offending was mid-range on the scale of seriousness.  He suggested a fine of $200.  Mr. BALLE reminded the committee that Mr. ARGUE was a Junior Horseman that this was an error of judgement and it was Xmas Eve.  In fixing penalty the committee takes into account the guilty plea, the submissions of the parties, the recommended starting point, the offending is mid-to-lower end on the scale of seriousness, Mr. ARGUE’s clear record, his Junior Horseman status and the mitigating factors.  Balancing those matters but with emphasis on the mitigating factors a fine of $150 is imposed.  Mr. ARGUE is advised that any further breach of this rule would likely result in a much more substantial fine.
