An Information was lodged by Stipendiary Steward Mr TW Taumanu alleging that Trainer D Chandler failed to affix the front Carrier Strap of the Hopple so as not to come adrift resulting in his horse Monty Carlos breaking from its gait and then being pulled up.

An Information was lodged by Stipendiary Steward Mr TW Taumanu alleging that Trainer D Chandler failed to affix the front Carrier Strap of the Hopple so as not to come adrift resulting in his horse Monty Carlos breaking from its gait and then being pulled up.
--Mr Chandler admitted the charge but he advised this Committee that he did wish to be present at the Hearing.
--Mr Taumanu gave evidence and said that in observing the race he saw that at about 500 metres after the start the front Carrier on the near side had come down on Monty Carlos and this resulted in the horse breaking from it’s gait and it had to be pulled up and took no further part in the race.
--Mr Taumanu said he had asked Mr Chandler to bring the Hopples to show the Committee because there was a special clip on the Hopple to prevent the buckle coming undone. Mr Taumanu stated that he had not seen this type of arrangement on Hopples before and he wanted the Committee to see it.
--Mr Chandler in giving his evidence, showed the Hopples with the special clip on them to the Committee. It was noted that the Hopples were in good condition. Mr Chandler said that a previous set of Hopples that he had, had broken and that the supplier under the terms of the guarantee had sent him this new set of Hopples which he had used on a number of occasions previously and had not ever had a problem. Mr Chandler explained to the Committee his procedure for checking the gear on a horse before it goes out and he had gone through this procedure and he simply could not explain why the front Carrier had come undone.
--Penalty Submissions
--The parties were asked to make submissions in respect to penalty. Mr Taumanu said that he had never had a problem with Mr Chandler before and that his horses were always properly presented as was Mr Chandler and that Mr Taumanu had some sympathy for Mr Chandler because of the special safety clip on the Hopples. Mr Taumanu said that notwithstanding the guideline fine of $250.00 that he was not looking for anything like that and he believed that this matter was at the very lower end of scale.
--Mr Chandler for his part acknowledged Mr Taumanu’s comments and could not add anything further.
--Decision
--The Committee assessed the evidence presented to it and in doing so advised Mr Chandler that notwithstanding that this matter was at the lower end of the scale it was still a safety issue because it happened during a race. Mr Chandler however was given credit by this Committee for not only his excellent record but also his guilty plea and the Committee took into account the submissions of Mr Taumanu. The Committee noted that in the Penalty Guide the recommended starting point for a fine is $250.00 but the Committee agrees with Mr Taumanu that this is at the very lower end of the scale and accordingly the Committee imposes a fine of $100.00.
