Decision: Following Race 3 an information was filed pursuant to Rule 304 by Stipendiary Steward Mr A Coles. He alleged that Mr M. Walker on the 30th day of April 2008 at Te Rapa at the racemeeting conducted by the Waikato Racing Club, being a licensed rider within the meaning of Rule 303 of the New Zealand Rules of Racing did misconduct himself within the meaning of Rule 304 of the said Rules

Following Race 3 an information was filed pursuant to Rule 304 by Stipendiary Steward Mr A Coles. He alleged that Mr M. Walker on the 30th day of April 2008 at Te Rapa at the racemeeting conducted by the Waikato Racing Club, being a licensed rider within the meaning of Rule 303 of the New Zealand Rules of Racing did misconduct himself within the meaning of Rule 304 of the said Rules, in that you did deliberately strike the horse HOW CANNHE across the head with your whip after the said horse ridden by you had finished the race.

Mr Walker admitted the breach.

Mr A Coles asked Racecourse Inspector Mr B. McKenzie who had spoken to witnesses of the offence to outline the facts.

Mr McKenzie stated that as Mr Walker was returning to the birdcage area at the conclusion of the race he was having difficulty in pulling his mount up. He stated the horse ran approximately 100 metre past the birdcage gate, at that point Mr Walker was seen by two members of the public to strike the horse over the head. Mr Walker managed to turn the horse around, and then was seen to strike the horse again along with jagging the horses’ mouth.

Mr Walker admitted the horse was giving him difficulties and had struck the horse over the head once, along with jagging the bit in its mouth.

Mr Walker said the horse had hung the whole way and had been difficult to pull up at the finish of the race. The horse continued to be difficult to control as he returned to the birdcage. It was Mr Walker’s opinion that the horse should barrier trial prior to going back to the races.

Penalty

--

Mr A Coles produced Mr Walkers record which was as good as far as this charge is concerned. He asked for a fine in the vicinity of $750.

Mr Walker’s submission on penalty was that the offence did not warrant a suspension.

The committee carefully considered all the submissions and evidence as presented with the following being relevant

Accordingly we impose a fine of $700.
