Mr Ching made a request for a ruling pursuant to Rule 865A of the Rules of Racing seeking a ruling as to whether JUSTLIKETHAT should be declared a non starter.
--We viewed the head on film which showed quite clearly how the gate from barrier position 6 opened wide into the path of JUSTLIKETHAT and clearly impeded its start. We are in no doubt that the action of the gate constituted a mechanical failure, which denied JUSTLIKETHAT a fair start.
--JUSTLIKETHAT is therefore declared a non starter.
--Mr Ching then sought a further ruling with regard to the late scratching fee. The connections of the horse submitted that with the horse having been denied a fair start due to reasons beyond control that no late scratching fee should be paid.
--We agree. Late scratching fee is waived.
