This is an information instigating a protest filed by Stipendiary Steward Mr. T. TAUMANU on behalf of ZUTANO driven by Mr. J. STORMONT placed 4th by the judge against MIAMI H driven by Mr. D. BUTCHER placed third by the judge on the grounds of interference with about 500 metres to run.

This is an information instigating a protest filed by Stipendiary Steward Mr. T. TAUMANU on behalf of ZUTANO driven by Mr. J. STORMONT placed 4th by the judge against MIAMI H driven by Mr. D. BUTCHER placed third by the judge on the grounds of interference with about 500 metres to run.  The margin between the two horses at the finish of the race was one length.  Mr. K. MARR, part owner and Mr. BUTCHER represented the connections of MIAMI H and Ms. L. HAMILTON (on behalf of trainer S. ARGUE) and Mr. STORMONT represented the connections of ZUTANO.

Mr. TAUMANU showed the film of the incident.  He said MIAMI H came in and struck the front legs of ZUTANO which broke and lost several lengths.

Mr. STORMONT confirmed the inward movement of MIAMI H resulted in contact and caused ZUTANO to break.

MR. BUTCHER said MIAMI H was a three year old having its first start, was green, and ducked inwards.

DECISION AND REASONS;

--

The inward movement of MIAMI H caused interference to ZUTANO.  MIAMI H has breached rule 869 (4A).  The interference affected the chances and progress of ZUTANO.  The committee has a discretion to relegate MIAMI H by virtue of rule 869 (8).  Because ZUTANO lost several lengths as a result of the interference and the margin between the two horses at the finish of the race was only one length, the committee exercises its discretion and relegates MIAMI H to immediately behind ZUTANO, the final placings then being:
