Following the running of Race 1, the Criterion Hotel Trot, an information was laid by Stipendiary Steward Mr S. P. Renault against Mr B. J. Ford, the driver of GRANT US PEACE (1), alleging that he had committed a breach of Rule 869(2)(a) in that he used his whip excessively.

Following the running of Race 1, the Criterion Hotel Trot, an information was laid by Stipendiary Steward Mr S. P. Renault against Mr B. J. Ford, the driver of GRANT US PEACE (1), alleging that he had committed a breach of Rule 869(2)(a) in that he used his whip excessively.
--Mr Ford had indicated on the information that he admitted this breach of the Rules and he confirmed this at the hearing. Mr Ford also agreed that he understood the charge, the Rule it was brought under, and the “Use of the Whip” guidelines.
--Mr Renault gave evidence and used video coverage to show that Mr Ford had used his whip on about 25 occasions in the run home, without a lot of discernable pauses, and that this was too much. It was also pointed out that Mr Ford had stopped using the whip with a little less than a 100 metres to run when it was clear that his horse was beaten.
--Mr Ford had written on the Information – “It appears that I was using the whip vigorously but I was only flicking the horse”.
--Mr Ford said that GRANT US PEACE was a lazy horse, and that he had only hit his horse about three times at the start of the straight, and after that he had been using mostly wrist movements. Mr Ford did not dispute that he had used his whip on about 25 occasions.
--Penalty:
--In relation to penalty Mr Renault advised that Mr Ford had no relevant previous convictions, and as he had admitted the breach a fine of $200-00 was recommended.
--We adjourned to consider the matter of penalty. We took into account that Mr Ford had no previous relevant convictions, and he advised us that this was the first time he had been charged under this Rule. We also took into account his guilty plea. Finally we considered that this breach was at the lower end of the scale in seriousness. Taking into account all these matters we considered that an appropriate fine in this case was $150-00.
--On resuming the hearing we advised the parties that Mr Ford was fined the sum of $150-00.
