Following the running of Race 11, the Speight’s Rating 75, Stipendiary Steward Mr J. P. Oatham laid an information pursuant to Rule 871(1)(d) alleging Jockey Mr T. R. Moseley rode carelessly.

Mr Moseley had indicated on the information that he admitted this breach of this Rules, and he confirmed this at the hearing.  Mr Moseley also acknowledged that he understood the Rule and the charge.

This incident was illustrated by means of video coverage, and showed that near the 1600 metre mark Mr Moseley (“Leontes”) allowed his horse to shift ground inwards when not sufficiently clear causing tightening and checking “Rapaura Road” (A. Mundy).

Mr Moseley agreed that he had made an error in judgement, but said that at the time he believed that he was clear.

PENALTY:

In relation to penalty Mr Oatham advised that Mr Moseley has an excellent record notwithstanding a conviction earlier today for careless riding.  This was assessed as another breach at the bottom end of the scale, and as Mr Moseley had pleaded guilty a further suspension of three days was recommended.

Mr Moseley made submissions that a shorter suspension and a fine might be considered.

DECISION ON PENALTY:

          In considering an appropriate penalty in this case, to Mr Moseley’s credit, we took into account that this was a breach at the lower end of the scale and that Mr Moseley had pleaded guilty.  We also took into account that up to today Mr Moseley has had an excellent record with no breaches of this Rule for two years.  We did not agree with Mr Moseley that this would be a suitable case to impose a shorter suspension coupled with a fine.  We were satisfied that the three day suspension recommended by Mr Oatham was very fair.

          Accordingly Mr Moseley was suspended from after the completion of racing on 19 October 2008 until after the completion of racing on 2 November 2008, which is three South Island riding days.
