--Following the running of Race 4, The Andres Pies Maiden 3yo, Mr. J Riddell was charged with careless riding under rule 638 (1) (d). The information alleged that J Riddell the rider of BATATIUS allowed his mount to shift inward near the 200m when not the required distance clear of YANGMING (M. Walker) which had to check.

--Following the running of Race 4, The Andres Pies Maiden 3yo, Mr. J Riddell was charged with careless riding under rule 638 (1) (d). The information alleged that J Riddell the rider of BATATIUS allowed his mount to shift inward near the 200m when not the required distance clear of YANGMING (M. Walker) which had to check.
--Mr. Riddell did not admit the breach.
--Mr. Neal called Mr. Michael Walker as a witness. He told the committee that he had a clear run on the inside next to the running rail when Mr. Riddell moved inwards in front of him when only about a length clear. This caused him to check his mount which he said was only battling at the time.
--Mr. Goodwin then demonstrated the incident on the videos. He identified the horses involved and showed Mr. Riddell allow his mount to move inwards when riding forward with vigour. As he crossed into the line of running of YANGMING Mr. Walker was forced to check his mount.
--The Stewards maintained that no other riders contributed to the incident.
--Mr. Riddell told the committee that BATATIUS was a difficult horse to ride and as a result wore a one-cup blinker. The basis of his defence was that pressure came from his outside due to Mr. Hannam’s mount shying inwards with subsequent movement inwards from Mr. Bosson. He was aware of his mount moving inwards but thought that Mr. Walker had dropped away and he was clear of him. Mr. Riddell maintained he could not straighten his mounts line of running because at that stage Mr. Bosson had moved inwards and taken the line he had previously been on.
--Decision
--The committee had careful regard to all of the submissions put before it. It was our view that Mr. Riddell did move inwards when not the required distance clear of YANGMING. Mr. Walker was quite clear in saying he was forced to check his mount when Mr. Riddell moved in and took his line of running when only a length clear.
--The side on film confirmed Mr. Walker’s estimated distance and the head-on video showed Mr. Walker having to pull back from his position with YANGMING suffering a significant check.
--Mr. Riddell maintained that his inward movement was due to pressure from his outside. After viewing the videos from both angles and at different speeds we were of the opinion that Mr. Riddell’s mount BATATIUS moved in of its own accord.
--While the videos did show some general movement from Mr. Hannam and Mr. Bosson there was no contact and we did not accept that they were responsible for any pressure on Mr. Riddell.
--The charge of careless riding brought under Rule 638 (1) (d) was found proved.
--Penalty
--Mr. Neal’s submissions to the committee included producing Mr. Riddell’s riding record which showed previous charges of careless riding on 29/10/09 and 30/5/09.
He said that today’s incident was in the mid-range of careless riding and called for a suspension in the vicinity of 4 days.
Mr. Riddell told the committee that he rides in both North and South Islands and that any suspension would impact on his weight. He said that he had riding commitments up to and including Sunday January 3rd.
--In coming to a decision on penalty the committee considered all of the submissions put before it. We took into account the degree of interference which we agreed was in the mid-range. Mr. Walker received a significant check and despite saying that he was weakening at the time he had every right to a clear and safe line of running.
--Mr. Riddell is suspended from the close of racing on Sunday 3rd January 2010 until the close of racing on Thursday January 7th – in effect four riding days.
