Following Race 2 an information was laid against jockey, LK Cropp, rider of DAUNTLESS (No.5) alleging a breach of Rule 871(1)(d).

DECISION AND REASON:

--

Following Race 2 an information was laid against jockey, LK Cropp, rider of DAUNTLESS (No.5) alleging a breach of Rule 871(1)(d).

--

The information, No.7856, reads, "that she shifted outwards on her mount DAUNTLESS, No.5, over the final 200 metres when not sufficiently clear causing checks to ONMEPATMALONE, No.11, ridden by L Innes and INDIKATOR, No.7, ridden by N Harris."

Ms Cropp has denied this charge of careless riding.

Mr J Oatham gave evidence and demonstrated on the race video films (head-on, side-on and rear) at approximately at the 200 metre mark, Ms Cropp allowing her mount DAUNTLESS to move outwards into the lines of INDIKATOR (N Harris) and ONMEPATMALONE (L Innes). He said, at no time was the required distance clear of those two runners. He said she kept riding forward from the 200-metre mark when indeed she should have stopped riding to straighten her mount. Mr Oatham also said that N Collett on the outside of Ms Cropp had no bearing on the interference.

Mr Coles called Mr Innes, who confirmed that he suffered interference from Ms Cropp who was only one length ahead of him when she took his line. He had to check for six strides.

Mr Harris, rider of INDIKATOR said he was in a challenging position to win the race when L Cropp came from his inside and the gap he was entitled to closed. He said Ms Cropp was three quarters of a length ahead of him at the time. He said he stopped riding for approximately six strides.

Ms L Cropp gave evidence. She said she was riding a 500kg horse and it was an erratic horse. She said that from barrier rise the horse was hanging. She said the horse gave her a warning and she straightened him. She believed that she did everything she could to keep him straight. She said she had no idea that Mr Harris and Mr Innes were there.

Decision:

The committee carefully considered the evidence of all witnesses and the visual evidence, and preferred the evidence of Messrs. Oatham, Innes and Harris. The committee found that Ms Cropp allowed her mount to shift outwards at the 200-metre mark when not sufficiently clear of INDIKATOR and ONMEPATMALONE, consequently denying them of their rightful line of running. The committee acknowledged that her mount was hanging but Ms Cropp kept riding forward. Accordingly the charge of careless riding was found proven.

Charge under Rule 871(1)(d) proven.

Penalty:

After hearing all submissions on penalty the committee determined that a suspension be imposed. Taking into account the following ?

  1. Good riding record, bearing in mind that she is a busy rider in the North and South Island.
  2. --
  3. Ms Cropp's explanation and the fact this horse was hanging.
  4. --
  5. Pursuant to Rule 1122, the consequences of the careless riding, double relegation, two horses suffered interference.

The starting point is 5 days, but taking into account the mitigating factors the committee reduced that to 4 days.

Ms Cropp's jockeys licence is suspended from the conclusion of racing at Tauranga on the 2 January 2007, up to and including the 11th of January 2007.
