Decision:

Following Race 5 an Information was filed pursuant to Rule 871 (1) (D).  The Informant Mr A Coles alleged that Mr A Calder, rider of MYSTABRETT allowed his mount to shift inwards near the 600 metres when not sufficiently clear of ROZANA (S. Spratt) who was checked.

Following Race 5 an Information was filed pursuant to Rule 871 (1) (D).  The Informant Mr A Coles alleged that Mr A Calder, rider of MYSTABRETT allowed his mount to shift inwards near the 600 metres when not sufficiently clear of ROZANA (S. Spratt) who was checked.

Mr Calder did not admit the breach.

Mr Oatham demonstrated the video films which showed Mr Calder riding MYSTABRETT racing 3 wide and outside SIR CAYDEN (J McDonald) and ROZANA (S Spratt).  Approaching the 600 metre mark it was clearly evident on the video films that MYSTABRETT moved in and in doing so move into the rightful running line of ROZANA which resulted in a sharp check to that runner.  Ms Spratt, rider of ROZANA, said she did receive a check from the outside horse MYSTABRETT which she said was ¾ to 1 length clear of her when it moved in.  She said this resulted in her having to check out of it.

Mr V Ho, rider of MR ALFIE was called. He said he was racing behind Ms Spratt and was inconvenienced by that runner when it came back on him.

Mr J McDonald was the next witness and he stated that his mount was in front and railing well and any outward movement by him, if any, was marginal.

Mr Calder, rider of MYSTABRETT, said in his statement he was having difficulty with his mount and having trouble restraining it.  He said he went to slide forward and was aware of Ms Spratt on his inside.  He said he did not roll in but put emphasis on the fact that it was a sharp corner and he had to pull his horse’s head around to make the corner correctly.

Mr Coles, in summing up, said it was clear that Mr McDonald kept a true line and it was evident that it was Mr Calder’s inward movement which resulted in the check to Ms Spratt.

DECISION

--

The Committee carefully considered all the evidence presented and reviewed the video films.  We are clearly satisfied that Mr Calder moved in from a 3 wide position to one of 2 wide without being the required distance clear.  This was confirmed by Ms Spratt who said Mr Calder was approximately ¾ to 1 length clear of her mount when he moved in.

Accordingly we find the charge proven.

PENALTY SUBMISSIONS:

--

Mr Coles presented Mr Calder’s record which showed 2 charges in the last 12 months.  He said that was a good record and submitted a 4 – 5 day suspension was appropriate.

--

Mr Calder said he had commitments until the conclusion of tomorrow’s racing (1/8/09).  He said he was not riding at Hawera on 2 August 09.

PENALTY:

--

The Committee carefully considered all submissions and before imposing a fair and correct penalty took into account the following:

--

• Mr Calder’s good record
• The manner in which the horse was racing
• That the interference took place on the point of the turn.

--

However these facts have to be balanced against the sharp checks received by Ms Spratt and Mr Ho which were caused by the carelessness of Mr Calder.

--

Accordingly we impose a suspension on Mr Calder from riding in races which is to start after racing on 2/8/09 and conclude after racing on 12/8/09 (4 days)
