Meet Title:

Race Date:
2004/11/20
Race Number:
Race 1
Decision: --
This is a protest by Lance Noble, trainer of BRAVE REGENT (L Innes) placed second by the Judge alleging interference by PIN HIGH (G Grylls) placed first by the Judge in the final straight.
| -- DECISION & REASON: ----This is a protest by Lance Noble, trainer of BRAVE REGENT (L Innes) placed second by the Judge alleging interference by PIN HIGH (G Grylls) placed first by the Judge in the final straight. The margin between first and second was a short head. Stipendiary Steward A Coles reserved the right to charge. ----Mr Noble demonstrated the incident on video both head-on and from the rear. He asked the Committee to note that interference occurred on at least two occasions. The second he felt was the more important as it pushed BRAVE REGENT off line at a critical stage of the race. BRAVE REGENT was, he said, a big strider and had been put off balance thereby affecting its chances given the margin of a short head. ----Mr Innes confirmed that he had been forced wider by one and a half widths and he was sure it cost him the race. Questioned by Mr Grylls about whether contact had occurred he insisted that it had, especially on the second occasion. ----Mr Grylls was sure there had been no contact and in fact BRAVE REGENT had moved in slightly at the start of the incident. Mr Verner said that he accepted what Mr Grylls had said and Mr Davey, one of the owners of PIN HIGH, said that any outward movement was less than one and a half widths and there had to be some doubt whether the chances of BRAVE REGENT were affected as a result. ----The Committee has considered all the evidence and the video and is satisfied that interference has occurred. On the issue of whether that interference has affected the chances of BRAVE REGENT it is satisfied that this has been established. Given the stage of the race and the margin of a short head it is satisfied that it should therefore exercise its discretion to alter the placings and the protest is upheld. ----The official placings will now be: --1st 8 BRAVE REGENT --2nd 14 PIN HIGH --3rd 1 FOURSFIELD --4th 16 LARRINKA --5th 12 STELLA CLARK --6th 10 LIBERAL?S STRIKE ----
