--This is an information instigating a protest filed by Stipendiary Steward Mr J MUIRHEAD on behalf of BY THE STARS driven by Mr P BUTCHER placed 10th by the Judge against ROYAL TIGER driven by Mr J STORMONT placed 3rd by the Judge on the grounds of interference about 60 metres from the finish of the race.
--Mr K COPPINS on behalf of trainer Mrs J COPPINS and Mr STORMONT represented the connections of ROYAL TIGER. Mr BUTCHER represented the connections of BY THE STARS.
--Mr MUIRHEAD showed the video films of the incident and gave his interpretation of them. He said that in the home straight ROYAL TIGER was racing outside BY THE STARS, LADY WILLPOWER driven by Mr F COONEY was inside BY THE STARS and ELENA S driven by Mr P FERGUSON was outside ROYAL TIGER. At about the 60 metre mark ROYAL TIGER was under a drive and drifted inwards. Its sulky wheel made contact with the front leg of BY THE STARS which broke and had its chances eliminated. He said BY THE STARS was 4th at the time of the incident and was tiring.
--Mr COONEY, Mr FERGUSON, Mr BUTCHER and Mr STORMONT all gave evidence. They did not contradict the evidence of Mr MUIRHEAD that ROYAL TIGER caused interference to BY THE STARS. However, Mr BUTCHER said BY THE STARS was tired and at best would have run 7th.
--DECISION AND REASONS
--The committee accepts the uncontradicted evidence of Mr MUIRHEAD that ROYAL TIGER caused interference to BY THE STARS and in so doing breached Rule 869 (4A). The committee accepts the evidence of Mr BUTCHER that but for the interference BY THE STARS at best would have finished 7th. His evidence was in accord with the committee’s interpretation of the video films. In addition Mr MUIRHEAD acknowledged that BY THE STARS was tiring at the time of the incident. The committee is satisfied the chances of BY THE STARS finishing in a stake bearing or dividend bearing position were not affected. The protest is therefore dismissed.
