Following the running of race number 6 an information was lodged by the Stipendiary Stewards instigating a protest in respect I?m A Dazzler placed 5th by the Judge.

DECISION & REASON
--Following the running of race number 6 an information was lodged by the Stipendiary Stewards instigating a protest in respect I?m A Dazzler placed 5th by the Judge.
----The information alleged that with approximately 100 metres to run I?m A Dazzler (J Keast) interfered with Drell (K Barron). The information was lodged under Rule 869 (8) and the Passing Lane Regulations.
--Mr Escott at the commencement of the hearing indicated that the Stipendiary Stewards sought the relegation of I?m A Dazzler behind Drell on the basis that interference occurred to Drell as a consequence of I?m a Dazzler moving in and into the passing lane when not sufficiently clear.
----Mrs K Williams, Stipendiary Steward, said that she was situated in the box at the entrance to the main straight and observed a gap insufficient for a horse to move through and noted Mr Keast take I?m A Dazzler into the gap and as a result Drell was taken hold of, checked and broke.
----Mr Keast said that he noticed a gap, attempted to move into it and it closed and as a result the trailing horse Drell was taken hold of and broke. Mr Escott said that there was never room for the manoeuvre to be carried out in safety and that Mr Keast was not entitled to move his horse into the gap when not sufficiently clear.
----The Committee after giving consideration to the evidence of both parties is satisfied that interference occurred to Drell which was a result of inward movement of I?m A Dazzler with approximately 100 meters to run. It is the Committee's view that the evidence of the Stipendiary Stewards correctly sets out the situation that occurred. The Committee reached that conclusion given our observation of the films, the race itself and the evidence of the witnesses.
----Having found interference occurred the Committee then had to determine whether or not the chances of Drell were affected and it is our view that they were. Drell broke as a result of the interference and lost any chance of finishing in a better place. Accordingly the protest is upheld and I?m A Dazzler is relegated to immediately behind Drell. The stake bearing placings now read 6, 8, 2, 11, 9.
