Mr Knowles, stipendiary steward, protested against the 3rd placing of CHEW THE FAT in race 1 on the ground that it broke from its gait approximately 30 metres after the winning post until approximately 20 metres short of the 800 metre peg. The information alleged a breach of R 870(2)(c), in that the horse failed to lose ground in the break.

Mr Knowles, stipendiary steward, protested against the 3rd placing of CHEW THE FAT in race 1 on the ground that it broke from its gait approximately 30 metres after the winning post until approximately 20 metres short of the 800 metre peg. The information alleged a breach of R 870(2)(c), in that the horse failed to lose ground in the break.

Judge’s placings were 12, 6, 2, 5, 9, 10, 1.

Mr Allison, stipendiary steward, demonstrated on the video that CHEW THE FAT, when racing 3 back on the fence, broke and continued in a gallop for a distance that was estimated to be 150 metres.  Mr Knowles stated that because of where CHEW THE FAT was positioned at the time it was not feasible for Mr McNally to take the horse clear of the field.

CHEW THE FAT continued to hold its position on the back of the horse it was trailing, only losing ground marginally when eventually restrained in the last 10 to 20 metres of the 150 metres distance that it had been in a gallop.  Significantly, CHEW THE FAT retained its position in the field behind the horse it had been trailing before it broke.  We are satisfied that CHEW THE FAT did not lose ground in the break and, in these circumstances, we exercise our discretion to disqualify pursuant to R 1003(2).
