DECISION & REASONS:
--Information 7759 alleged a breach of Rule 871(1)(d) for careless riding by jockey, Opie Bosson for shifting inwards on BOOGI ON THE GRASS when not the required distance clear of OUR SHOWBOAT (L Hofmann) who had to be sharply checked by its rider. The breach was not admitted.
----Lynsey Hofmann confirmed that with 700 metres to run she was riding SHOWBOAT about three wide from the running rail with Mr Bosson outside and FINE CUT (K Hercock) on her inside. At that stage he came in and she had to take hold of her mount. As a result she had to check sharply and lost a length to a length and a half. She confirmed when questioned by Mr Bosson that his horse had been running in on her "pretty much throughout the race due to greenness and the ground."
----Kate Hercock confirmed she rode FINE CUT and received tightening and was yelling with Mr Hain three quarters of a length off her. Lynsey had nowhere to go, she had nowhere to go and she was concerned she could be forced on to and over the running rail. She was checked as a result quite severely but not as sharply as Miss Hofmann.
----Stipendiary Steward J P Oatham demonstrated the incident on video. He pointed out the movement in by Mr Bosson from his position four wide on the turn in to the straight and the resulting check to Miss Hofmann when a bare length clear of her. He drew attention to the corrective action by Mr Bosson after the incident but in his view this was too late. While it had been difficult for Mr Bosson beforehand, as the video showed, it also meant that Mr Bosson was aware of the problem and for a rider of his experience he should have been able to deal with it.
----Mr Bosson stated that he accepted his horse had moved in on the turn but it was very green, and controlling it had been a problem for him throughout the race. In fact he had tried to go forward on the turn to prevent it running in but in doing so it had still come in half a horse width, which, as it turned out, had been sufficient to cause the resulting tightening. He asked the Committee to note that it had continued to be a problem up the straight due to greenness and also being in season.
----Mr Coles in summing up said that the video clearly showed the incident and he agreed the horse was green causing problems as stated by Mr Bosson both before and after the incident. However, in rolling in, although it was marginal, the checks to both horses inside were evident and the corrective action had been too late. In saying that he also accepted the horse had not helped itself and its greenness had probably cost it the race.
----The Committee took into consideration all these matters and particularly what Mr Bosson had put to it regarding the greenness of his horse. Despite this the evidence disclosed a serious check on the point of the turn into the straight and the question of safety arising from this was a matter of concern. On balance the Committee found that Mr Bosson had been careless in that, despite the acknowledged difficulty he was having, his corrective action had been too late and a rider of his experience should have been able to handle a situation like this without it getting to the stage it did.
----The Committee after considering these matters and submissions on penalty noted that Mr Bosson has had one recent charge on 2 September 2006, reduced on appeal to a suspension of five days. It also accepts the mitigating factor of the greenness of the horse and Mr Coles submission that this breach is at the lower end of the scale for penalty purposes and Mr Bosson is not a person who goes out to offend. Accordingly a three day suspension is ordered to take effect from the conclusion of racing on Saturday 7 October 2006 until the conclusion of racing on 14 October 2006 the meetings affected being those at Whangarei, Otaki, and Rotorua.
