DECISION AND REASONS:

Following the running of Race 1, the Avon City Ford Mobile Trot, an information was laid by Stipendiary Steward Mr N. G. McIntyre against Mr P. R. Lamb the holder of an Open Starters Licence. The Information alleged that Mr Lamb failed to call a false start in accordance with Rule 861(1). The information reads as follows.

"I, the abovenamed informant allege that the abovenamed Defendant

committed a breach of Rule 861(1) in that Starter P. R. Lamb failed to call a false start after Victory Cheer and Gina could not be drawn up into their correct positions behind the mobile gate resulting in both horses being declared late scratchings by the Stipendiary Stewards ."

Rule 861(1) provides as follows.

--

"Each horse shall as far as practicable be drawn up before the start upon its proper mark and position by the starter and/or his assistant(s)."

Mr Lamb had indicated on the Information that he admitted this breach

--

of the rule and he confirmed this at the hearing. Mr Lamb also agreed that he understood the charge and the Rule it was laid under.

--

Mr McIntyre said that at the time that this race was started "Victory Cheer", (drawn 3 on the front line) and "Gina" (drawn 2 on the second line) were not drawn up in their correct positions behind the mobile gate. As a result both these horses were late scratched from the race.

Stipendiary Steward Mrs Williams used video coverage to show the relative positions of the two horses at the start of the race.

Mr Lamb said, in mitigation, that this was a mobile start race for a field of inexperienced maiden trotters. Mr Lamb also said that he was not convinced that "Victory Cheer" (Ray Jenkins) was going to get onto the gate in any event.

Penalty: Mr McIntyre advised that Mr Lamb had been the Starter at Addington Raceway since the beginning of this season, and that he not breached the Rules since that time. Mr McIntyre referred to a Starters penalty report and recommended a fine on $150-00 in this case. Mr Lamb considered that a fine of $150-00 was excessive.

I adjourned to consider an appropriate penalty. I was satisfied that in recent times the penalties for a breach of this Rule have ranged between $100-00 (in 1997) and $250-00. Taking into account the recommendation by Mr McIntyre, and also taking into account the submissions made by Mr Lamb in mitigation, I was satisfied that the recommended fine of $150-00 was appropriate, and Mr Lamb was fined this amount.
