Decision: Under Rule 869 (4) : The information alleges that S. Dickson the driver of “Sunwise” drove in a manner likely to cause interference when he attempted to keep “B.B. Gill” N. Chilcott from improving on “Sunwise”s”inside, as a result “B.B. Gill” broke with approximately 400 to run.
Under Rule 869 (4) :

Mr Dickson was present at the hearing and did not admit the breach, the rule was read and Mr Dickson acknowledged he understood same.

Films of the alleged incident were shown and clearly showed Miss Chilcott trying to improve on Mr Dickson’s inside and he deliberately attempting to hold her horse down and thus caused the horse to break.

Miss Chilcott was in a position where she could improve and was entitled to do so.
----
Mr Dickson felt the angle of the film did not give a true indication as to he and Miss Chilcott’s position and said he was only trying to hold his line.

Miss Chilcott when asked was in no doubt that Mr Dickson’s horse had caused her horse to break by Mr Dickson. trying to hold her in or push her horse down..
----
Having heard all of the evidence and viewed the films shown them the Committee found the breach proven.
----
In submission as to penalty Mr Taumanu pointed out to the committee that it was less than a month since Mr Dickson had been charged under this rule, he felt a monetary penalty of between $500 and $600 or a two week suspension would be appropriate.

Mr Dickson asked for a suspension.
----
The Committee felt a two week suspension was appropriate and said Mr Dickson may drive the second day here i.e. 1/3/09 and is then suspended until the conclusion of racing on the 15/3/09 (2 weeks) which encompasses 5 days. They also reminded Mr Dickson of his obligations and advised him to take this as a Judicial warning that any breach of Rule 869 in the near future by him would incur a lengthy suspension.
