Following the running of Race 2, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Public Trainer, Mr K M James, alleging a breach of Rule 864 (2) (d) in that Mr James “affixed the removeable hood on PERAKI CHIEF [trained by him] which was unable to be activated”.

Following the running of Race 2, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Public Trainer, Mr K M James, alleging a breach of Rule 864 (2) (d) in that Mr James “affixed the removeable hood on PERAKI CHIEF [trained by him] which was unable to be activated”.

Mr James had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.

Rule 864 provides as follows:
(2)   Every horseman, owner, trainer and assistant thereof shall with regard to that horse ensure that:-
       (d)   all gear is correctly applied and/or affixed so as not to malfunction or come adrift.

Mr Ydgren, representing Mrs Williams, showed a video replay of the final 200-300 metres of the Race. He pointed out PERAKI CHIEF trailing the leader approaching the home turn. Mr James could be seen to unsuccessfully attempt to activate the removeable hood on two occasions. The cord, which had been set too long, had become wrapped around the “T” on the harness, Mr Ydgren said. Mr James reported the malfunction to Mr McIntyre, Stipendiary Steward, following the horses returning to the stables area.

Mr Ydgren recommended a fine of $100.

Mr James was fined the sum of $100.
