An information lodged by Stipendiary Steward Mr J Muirhead against Mr M White (Junior Horseman), driver of SPECIALIAM alleging a breach of Rules 869(4) and (6) (b)(c) ? Push Out and causing interference ? in that Mr White improved his horse with 1050m to run forcing SUMMER MAN, driven by Mr P Ferguson, to race wider on the track. Mr White admitted the breach and was assisted at the hearing by senior horseman Mr P Jeffries. Mr Muirhead demonstrated the incident by use of the video film. Mr White moved his horse outwards with 1050m to run forcing SUMMERMAN to race wider on the track. There was a clear breach of the Push-Out rule. Mr White accepted the version of events given by Mr Muirhead.

Penalty:

Mr Muirhead said that Mr White had only one breach of the rules in the last 12 months, that being for careless driving in July 2005. He suggested a fine of $200, taking into account the guilty plea. Mr White and Mr Jeffries accepted Mr Muirhead's submission. In fixing penalty the Committee took into account the following matters:
