--Following Race 9 an information was filed pursuant to Rule 638(1) (d). The Informant, Stipendiary Steward Mr A Coles alleged, that near the 1100 metres, C.Lammas (HALLAVAGAL) allowed his mount to shift in when not the required distance clear causing crowding to HOP HONOR (J Bruning) and a check to THE TOOTHFAIRY (S.Spratt).

--Following Race 9 an information was filed pursuant to Rule 638(1) (d). The Informant, Stipendiary Steward Mr A Coles alleged, that near the 1100 metres, C.Lammas (HALLAVAGAL) allowed his mount to shift in when not the required distance clear causing crowding to HOP HONOR (J Bruning) and a check to THE TOOTHFAIRY (S.Spratt).
--Mr C.Lammas admitted the breach.
--Stipendiary Steward Miss S Moore demonstrated the video films and showed at the 1100 metres Mr Lammas when racing in a 3 wide position allowed his mount HALLAVAGAL to shift in when only ¾ length to a bare length clear. This resulted in crowding to HOP HONOR and THE TOOTHFAIRY who received a sharp check and made contact with the running rail.
--Mr Lammas admitted he shifted in because he saw only one horse on his inner, when in actual fact there were two horses.
--PENALTY SUBMISSIONS
--Mr Coles produced Mr Lammas’s record which showed 4 suspensions in the last 12 months. He said it was an error of judgment which resulted in a sharp check to Miss Spratt and submitted a 4-5 day suspension was warranted.
--Mr Lammas told the Committee that he had firm commitments at Te Rapa on March 20 and he rides only in the North Island.
--PENALTY
--The Committee carefully considered all the evidence and submissions before imposing an appropriate penalty. Mitigating factors are Mr Lammas’s admission of the breach and his reasonable record. However these have to be balanced against the sharp check received by Miss Spratt which the Committee considers to be mid range of carelessness. We accept Mr Lammas has firm riding commitments on March 20.
--Balancing all of those factors with emphasis on the interference suffered by Miss Spratt we impose a suspension on Mr Lammas from riding in races which is to start after racing on 20 March 2010 and to conclude after racing on 28 March 2010 (5 Days).
