Decision: An information was lodged by Stipendiary Steward Mr TW Taumanu against the fourth placing of horse number 1 SWAPS (Trainer Mr M Wallace) on account of that horse hanging and running outwards on two occasions and causing interference

An information was lodged by Stipendiary Steward Mr TW Taumanu against the fourth placing of horse number 1 SWAPS (Trainer Mr M Wallace) on account of that horse hanging and running outwards on two occasions and causing interference firstly to SHIRLEY (Driver G Smith) and secondly MIGHTY CREATION (Driver D Butcher).

Rule 869 (4) states “no horseman nor any horse shall during any race do anything which interferes or is likely to interfere with any other horseman and/or horse or its progress”.

The protest was not contested.

Evidence was given by use of the video film of the race and this clearly showed SWAPS hanging and running outwards shortly after the start causing SHIRLEY to move further out in the track and its driver G Smith to take evasive action.  The film then showed that when the field raced down the back straight for the first time, SWAPS was in the lead and again hung and ran outwards when being challenged by MIGHTY CREATION.  This movement caused MIGHTY CREATION to be pushed at least three cart widths wide on the track.

The film clearly showed that Mr AG Herlihy, the driver of SWAPS, was trying to keep his horse running in a straight line, but despite his efforts SWAPS did run out on the two occasions.

Taking all evidence into account, and the fact that the protest was not contested, I disqualified SWAPS from fourth place

The amended placings are now 11 first, 8 second, 4 third, 10 fourth, 13 fifth, 6 sixth.
