Decision:

Following Race 1 an Information was filed pursuant to Rule 871 (1) (D).  The Informant Mr J Oatham alleged that Ms S Spratt, rider of FRONTIER, shifted in near the 300 metres when not the required distance clear causing a check to bally magic (D Johnson) .

Following Race 1 an Information was filed pursuant to Rule 871 (1) (D).  The Informant Mr J Oatham alleged that Ms S Spratt, rider of FRONTIER, shifted in near the 300 metres when not the required distance clear causing a check to bally magic (D Johnson) .

Ms Spratt pleaded guilty to the charge.

Mr Coles demonstrated the video films which showed, near the 300 metre mark, Ms Spratt angle her mount in for a clear run. Mr Coles pointed out there was no room on her outside but in taking the inside option she took the line of BALLY MAGIC (D Johnson) when only ¾ length clear of that runner.  As a result, Miss Johnson had to check quite sharply.

Ms Spratt said, while admitting the charge, she moved in thinking there was room for 2 horses.  She said her horse moved in more than she intended.

Mr Oatham said the videos clearly showed Ms Spratt had moved in and taken the rightful running of BALLY MAGIC.

PENALTY SUBMISSIONS:

Mr Oatham said Ms Spratt had incurred 3 charges in the last 12 months but had no charges in the last 6 months.  He submitted this was in the mid range of carelessness as Miss Johnson had received a reasonable check.  He believed the penalty should be at the lower end.

Ms Spratt said she had commitments at Rotorua and Pakuranga but was sure she could be released.  She pointed out declarations had not closed for either meeting.

PENALTY:

Before imposing a penalty the Committee called Mr Brown (Ms Spratt’s Agent) to confirm that he had spoken to all connections of Ms Spratt’s upcoming rides.  He said all had agreed to release her which meant any suspension could start after today’s racing.

Accordingly the Committee considered all evidence and the above submissions.

These are namely:
• Ms Spratt’s guilty plea
• Her record which is a good one.
• Her level of carelessness
• Her upcoming engagements and confirmation from Mr Brown of the release from her mounts on 21 and 22 August

Accordingly we impose a suspension to start after racing today, 19 August 09, up to and including 28 August 09 (5 days)
